Terminal Angle — Terms of Service

These terms are an agreement between you and GONEXTSO YAZILIM ÜRÜNLERİ SANAYİ VE TİCARET LİMİTED ŞİRKETİ ("GONEXTSO", "we"), Şişli / İstanbul, Türkiye (support@gonextso.com). By playing Terminal Angle: Armored Tower Defence ("the game") you accept them. Our Privacy Policy explains how we handle data: https://www.gonextso.com/terminal-angle/privacy

1. Eligibility

You must be at least 16 years old to play.

2. Your account

An account is created automatically on your device. On Android you can link a Google account to use it on other devices.
You are responsible for your device and, if you linked one, your Google account. We are not responsible for loss of progress caused by losing access to your device and, if you linked one, your Google account.
One person, one account. Accounts may not be sold, traded or shared.

3. Where your data is stored

Terminal Angle is one online game in which players from all over the world compete on the same leaderboards and leagues. So all players' data is kept in a single shared database. That database is kept outside Türkiye, on servers managed by our infrastructure provider Railway; the region where they are located may change. The Google services the game uses may also process data outside Türkiye.

By accepting these terms you expressly agree that the data listed in section 3 of our Privacy Policy is transferred and stored outside Türkiye for this purpose. Details: Privacy Policy, section 5. Changes to this section will be announced in the game and take effect only once you accept them again.

4. Virtual items and currencies

The game contains virtual currencies (such as silver and emerald), units, upgrades and other items. They are a limited, non-transferable, revocable licence to use content inside the game. They are not your property, have no real-money value, and cannot be exchanged for money or transferred outside the game.
We may change, rebalance or remove virtual items as part of running the game. Virtual currency you bought with money does not expire, and we will not remove it except as described in sections 5, 7, 8 and 9.

5. Purchases

Purchases are made through Google Play on Android and the App Store on iPhone and iPad, and are subject to that store's terms. Refunds are handled by the store under its refund policy (for the App Store: https://reportaproblem.apple.com) and applicable consumer law; we cannot refund store purchases ourselves.
Digital content you buy (virtual currency and items) is delivered to your account as soon as the purchase is confirmed. By confirming a purchase you agree to immediate delivery and acknowledge that you therefore have no right of withdrawal, to the extent permitted by applicable law (in Türkiye, Distance Contracts Regulation Art. 15(1)(ğ); in the EU, Directive 2011/83/EU Art. 16(m)). This does not affect the store's own refund policy.
Non-consumable purchases, if any, can be restored on another device with the store's restore function. Consumable items such as virtual currency stay in your game account and cannot be restored through the store.
If a purchase is refunded or charged back, we may remove the items it granted.

6. Advertising

The game may offer optional rewarded ads. Rewards are granted only after the ad network confirms the view and are subject to daily limits.

7. Acceptable use

You must not:

cheat, exploit bugs, or use bots, modified clients or tools that automate play or alter game data;
interfere with our servers, attack other players' accounts, or reverse engineer the game except as allowed by law;
use offensive, impersonating or unlawful player tags;
use the game for any unlawful purpose.

We may reset leaderboard results, remove items, or suspend or close accounts that break these rules.

8. Availability and changes

The game is an online service. We may update, change or discontinue features, and the service may be unavailable at times. If we decide to shut the game down entirely, we will announce it in the game at least 30 days in advance.

9. Deleting your account

You can delete your account at any time (Settings → System → Erase my progress, or https://www.gonextso.com/terminal-angle/delete-account). Deletion is permanent. Virtual items are lost and are not refunded.

10. Intellectual property

The game and all its content belong to GONEXTSO or its licensors. You get a personal, non-commercial licence to play the game.

11. Disclaimer and limitation of liability

The game is provided "as is" and "as available"; we do not guarantee that it will run without interruption or errors. To the extent permitted by law, we are not liable for indirect damages, lost profits or loss of virtual items. This does not limit our liability for intent or gross negligence. Nothing in these terms limits rights you have under mandatory consumer law.

12. Governing law

These terms are governed by the laws of the Republic of Türkiye. Disputes are resolved by the courts and enforcement offices of İstanbul, without prejudice to consumer arbitration committees and consumer courts where applicable. If you are a consumer living in the European Union, you also keep the protection of the mandatory consumer laws of your country of residence and may bring claims before its courts.

13. Changes

We may update these terms. We will post the new version here and, for material changes, notify you in the game. Continuing to play after changes means you accept them.

14. If you downloaded the game from the App Store

If you downloaded the game from the Apple App Store, your licence to use the game is governed by Apple's Licensed Application End User License Agreement (Standard EULA): https://www.apple.com/legal/internet-services/itunes/dev/stdeula/
These terms apply in addition; where they conflict with it on your licence to the app, Apple's agreement prevails. In addition:

You and GONEXTSO acknowledge that these terms are between you and GONEXTSO only, not Apple. GONEXTSO, not Apple, is solely responsible for the game and its content.
Your licence to use the game is non-transferable. You may use it on any Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, except that other accounts associated with the purchaser may also access and use it through Family Sharing or volume purchasing.
GONEXTSO alone is responsible for maintenance and support of the game (support@gonextso.com). Apple has no obligation to provide any maintenance or support.
GONEXTSO is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. If the game fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any. To the maximum extent permitted by law, Apple has no other warranty obligation for the game. Any other claims, losses, liabilities, damages, costs or expenses attributable to a failure to conform to any warranty are GONEXTSO's sole responsibility.
GONEXTSO, not Apple, is responsible for addressing any claims of you or any third party relating to the game or your possession or use of it, including product liability claims, claims that the game fails to meet a legal or regulatory requirement, and claims under consumer protection, privacy or similar laws.
If a third party claims that the game or your possession or use of it infringes their intellectual property rights, GONEXTSO, not Apple, is solely responsible for the investigation, defence, settlement and discharge of that claim.
You represent and warrant that you are not located in a country that is subject to a US Government embargo or designated by the US Government as a "terrorist supporting" country, and that you are not on any US Government list of prohibited or restricted parties.

You must comply with applicable third-party terms when using the game, such as your internet or mobile data provider's agreement.
You and GONEXTSO acknowledge and agree that Apple and its subsidiaries are third-party beneficiaries of these terms, and that when you accept these terms, Apple will have the right (and will be deemed to have accepted the right) to enforce them against you as a third-party beneficiary.
